By accessing, browsing, or using our website and purchasing our chips, you agree to be bound by the following terms and conditions ("Terms"). Please read them carefully before placing an order.
1. Eligibility & Account Responsibilities
- Age Requirement: By using this website, you represent that you are at least 18 years old or are accessing the site under the strict supervision of a parent or guardian.
- Account Security: If you create an account, you are solely responsible for maintaining the confidentiality of your credentials (username and password). You agree to accept responsibility for all activities, transactions, and orders that occur under your account.
- Inaccurate Info: We reserve the right to terminate accounts or refuse service if the information provided by you is inaccurate, misleading, or fraudulent.
2. Product Information & Pricing
- Perishable Goods: Our products consist of snack items (chips) with a specific shelf life. The manufacturing and expiry dates are printed clearly on each packet. It is the consumer's responsibility to check these dates before consumption.
- Visual Representation: We make every effort to display the weights, ingredients, and flavours of our chips accurately. However, actual packaging colours, shades, or shapes may vary slightly from the images displayed on your device screen.
- Price Modifications: All prices listed on the website are subject to change at any time without prior notice. Such changes will not affect orders that have already been accepted and paid for.
3. Orders, Payments, & Cancellations
- Order Acceptance: We reserve the ultimate right to refuse, limit, or cancel any order at our sole discretion. Reasons include, but are not limited to, stock unavailability, errors in pricing or product descriptions, or suspected fraudulent transactions.
- Secure Payments: All online payments are securely processed through authorized, certified third-party payment gateways. Orders will only be processed, packed, and fulfilled once formal payment confirmation is received by our system.
4. Shipping & Delivery
- Logistics Provider: We dispatch and deliver our products pan-India using Shiprocket and its automated network of courier partners.
- Delivery Timelines: Any delivery dates or windows provided on the site are pure estimates. We are not liable for transit delays caused by courier inefficiencies, adverse weather conditions, logistical bottlenecks, public holidays, or incorrect/incomplete delivery addresses provided by the buyer.
- Cash on Delivery (COD): For COD orders, you explicitly agree to pay the delivery executive the full cash amount printed on the invoice upon receipt of the package. Refusal to pay or accept verified COD orders may result in permanent suspension of your account and COD privileges.
5. Returns, Refunds, and Food Safety
- Perishable Policy: Due to the perishable nature of food items, we do not accept general returns or exchanges if you change your mind.
- Damages & Defects: If your package arrives structurally damaged during transit, tampered with, or contains incorrect items, you must report it to us within 24 hours of delivery.
- Mandatory Proof: To process a replacement or refund for damages, you must provide clear unboxing photos and an uninterrupted unboxing video via email. Requests without visual proof cannot be verified or processed. Please refer to our standalone Return & Refund Policy for detailed execution steps.
6. Intellectual Property
- Restrictions: You are strictly prohibited from copying, reproducing, modifying, republishing, distributing, displaying, or exploiting any content from this site for commercial purposes without our prior written consent.
7. Limitation of Liability
- Disclaimer: Yumchero,by Aarudhraa (OPC) Private Limited, along with its directors, employees, or partners, shall not be held liable for any indirect, incidental, special, punitive, or consequential damages resulting from:
- The use or inability to use our website.
- The consumption of our products past their printed expiry date.
- Any allergic reactions, food-borne illnesses, or adverse health effects caused by the consumption of our products. Customers with known food allergies—including but not limited to ingredients mentioned must refrain from consuming Yumchero chips, as our facility processes shared ingredients and we cannot guarantee an entirely allergen-free environment. Consumption of our products is entirely at the consumer's own risk. Delays, losses, or errors caused by third-party delivery or payment providers.
8. Governing Law & Jurisdiction
- Legal Jurisdiction: These Terms and Conditions shall be governed by, interpreted, and construed strictly in accordance with the laws of India.
- Dispute Resolution: Any disputes, claims, or legal actions arising out of or in connection with these Terms, your use of the website, or product purchases shall be subject to the exclusive jurisdiction of the competent courts located in the city where the company's registered office is situated.
9. Changes to Terms
- Amendments: We reserve the right to revise, update, or replace any part of these Terms & Conditions at our discretion by posting updates directly to our website. It is your responsibility to check this page periodically for changes. Your continued use of the website following the posting of updates constitutes explicit acceptance of those changes.
